Terms of Service

These Terms of Service ("Terms") govern your use of HushRead, including the website at hushread.app, the Chrome Extension, and the backend processing service (collectively, the "Service"). By using HushRead, you agree to these Terms. If you do not agree, please do not use the Service.

1. What HushRead Does

HushRead provides a Chrome browser extension and backend service that:

• Extracts article content from web pages you choose to process.
• Converts that content into EPUB format optimized for e-ink displays.
• Optionally translates article content using AI-powered translation.
• Delivers the resulting EPUB file to your Kindle or e-reader via email.

HushRead is a reading convenience tool. It does not host, store, or redistribute article content.

2. Accounts & Eligibility

You must be at least 13 years old to use HushRead. By creating an account, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the security of your account credentials. Notify us immediately at contact@hushread.app if you suspect unauthorized access.

3. Service Tiers & Usage Limits

HushRead offers two plans. Each plan is subject to the following limits, which exist to ensure fair use and service stability for all users:

* 500 articles/month is approximately 15–16 per day for normal personal reading. We reserve the right to apply reasonable limits to prevent automated abuse. See Section 5 (Fair Use) below.

Quota resets on the 1st of each calendar month at 00:00 UTC. Unused quota does not carry over.

4. Acceptable Use

You agree to use HushRead only for personal, non-commercial reading purposes. Specifically, you agree NOT to:

• Circumvent paywalls. Do not use HushRead to access content behind paywalls you have not legitimately subscribed to. HushRead processes the content visible in your browser — if you cannot read the article, neither can HushRead.
• Redistribute content. Do not use HushRead to mass-convert articles for republication, resale, distribution, or any commercial purpose.
• Automate or script usage. Do not use bots, scripts, browser automation (Selenium, Puppeteer, etc.), or any programmatic method to send requests to HushRead. The Service is designed for manual, human-initiated use via the Chrome Extension only.
• Share accounts. Your HushRead account is for your personal use. Do not share credentials or allow others to use your account.
• Abuse the translation service. The translation feature is for translating articles you intend to read, not for bulk translation of documents, datasets, or content for other purposes.
• Reverse-engineer or exploit the Service. Do not attempt to reverse-engineer, decompile, or exploit the HushRead backend, API, or Chrome Extension beyond their intended use.
• Overwhelm the Service. Do not intentionally submit requests designed to overload, stress-test, or degrade the Service for others.

5. Fair Use Policy

HushRead is built for readers, not robots. We enforce fair use limits to protect the Service and keep it sustainable. The following constitutes abuse:

• Sending more than the monthly article limit for your plan (10 for Drifter, 500 for Reader & Wanderer), or at a rate that suggests automated use (e.g. ~15–16/day is normal for the paid plan).
• Translating more than your plan allows (3/month on Drifter; fair use on Reader & Wanderer).
• Submitting articles that exceed 10,000 words (the maximum article length for all plans).
• Submitting identical or near-identical content repeatedly.
• Submitting content that is not a readable article (e.g. raw HTML, code dumps, random text, or content designed to exploit the translation pipeline).
• Creating multiple free accounts to circumvent tier limits.
• Submitting requests at a rate that suggests automated or scripted behavior (e.g. more than 10 requests within a 5-minute window).

What happens if you exceed fair use limits?

1. Soft limit: You'll receive an in-extension notification that you're approaching your limit. Processing continues.
2. Hard limit: Requests beyond the daily or monthly cap are queued and not processed until the next reset period.
3. Repeated abuse: If we detect a pattern of intentional abuse (e.g. scripting, multi-account creation, or deliberate exploitation of translation quotas), we may suspend or terminate your account with or without prior notice.

We understand that some days you might send more articles than usual — that's normal. These limits are designed to catch automated abuse, not to punish enthusiastic readers. If you have a legitimate need that exceeds these limits, contact us and we'll work something out.

6. Content & Copyright

You are responsible for ensuring you have the legal right to read and convert any article you process through HushRead. We do not verify the copyright status of content you submit.

HushRead processes publicly accessible web content at your direction. We act as a tool — similar to a browser's "Print" or "Reader Mode" function. We do not host, cache, index, or redistribute article content.

If you are a content creator or publisher and believe HushRead is being used to infringe your copyright, please contact us at contact@hushread.app with details and we will investigate promptly.

7. Payments & Subscriptions

The paid plan (Reader & Wanderer) is billed monthly at $6.99/month. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• All plans include a 7-day free trial. You will not be charged until the trial ends.
• You may cancel at any time. Your access continues until the end of the current billing period.
• We do not offer prorated refunds for partial months, but we may issue refunds at our discretion for service outages or billing errors.
• Prices may change. We will notify you at least 30 days before any price increase takes effect.

8. Beta Period

HushRead is currently in private beta. During this period:

• Features, pricing, and availability may change without notice.
• We do not guarantee uptime, delivery speed, or the continued availability of any specific feature.
• We may limit the number of users, invite-only access, or restrict certain features.
• Beta users may receive different pricing or extended free trials compared to post-launch users.

9. Service Availability

We strive to keep HushRead available 24/7, but we cannot guarantee uninterrupted service. Occasional downtime may occur due to maintenance, infrastructure issues, or third-party service outages (e.g. Mailgun, OpenAI, Anthropic).

We are not liable for any failure or delay in delivering articles caused by factors beyond our reasonable control.

10. Account Termination

By you: You may delete your account at any time by emailing contact@hushread.app. We will delete your data within 30 days per our Privacy Policy.

By us: We may suspend or terminate your account if you:

• Violate these Terms or our Fair Use Policy.
• Use the Service for illegal activity.
• Engage in behavior that threatens the security or stability of the Service.
• Create multiple accounts to circumvent tier limits.

Where possible, we will provide notice and an opportunity to rectify the issue before termination. In cases of severe abuse (automated scraping, exploitation of translation APIs), we may terminate immediately without notice.

11. Intellectual Property

HushRead, including its name, logo, Chrome Extension code, backend code, and website design, is the intellectual property of HushRead. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

The open-source libraries we use (Readability.js, Turndown, etc.) are subject to their respective licenses.

12. Disclaimer of Warranties

HushRead is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• The Service will be error-free or uninterrupted.
• Article extraction will work perfectly on every website.
• AI translation will be accurate, complete, or free from errors.
• EPUBs will render identically on all Kindle or e-reader models.

13. Limitation of Liability

To the maximum extent permitted by law, HushRead and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless HushRead, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ho Chi Minh City, Vietnam.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

Non-material changes (e.g. formatting, clarifications that don't affect your rights) may be made without notice.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
